The Nice administrative court has ordered the commune of Le Cannet to pay 52,600 euros after finding it had deliberately failed to comply with a 2024 court ruling requiring its mayor to grant a building permit to a property development company.
The dispute began in June 2023, when Le Cannet's mayor refused to issue a building permit for a plot at the intersection of route de Valbonne and chemin de la Puade. The court overturned that refusal in a June 2024 judgment, ordering the mayor to issue the permit within two months or face a daily penalty of 100 euros, a ruling that became final in November 2024 after the commune's appeal to France's supreme administrative court was rejected.
In a January 2026 ruling, the court found Le Cannet had deliberately continued resisting the judgment, noting the commune had instead exercised its right of pre-emption over the plot in January 2025, a move a judge suspended weeks later. That suspension became final in June 2025 after the commune's further appeal failed. With the penalty having accumulated since, the court has now provisionally liquidated it at 52,600 euros, with 10,000 euros going to the development company and 42,600 euros to the state.
